1 Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and DMV Web Guys LLC ("Company," "we," "us," or "our"). By accessing or using any of our Services — including our website at dmvwebguys.com, any mobile applications we publish, our website builder platform, and any related tools, APIs, or services — you agree to be bound by these Terms.

If you do not agree to these Terms, do not access or use our Services. If you are using our Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2 Description of Services

DMV Web Guys provides the following services ("Services"):

• Website & Platform: Our website at dmvwebguys.com and all associated subdomains
• Mobile Applications: All apps published by DMV Web Guys on Apple App Store, Google Play Store, or other platforms
• Website Builder: Our DIY drag-and-drop website creation and hosting platform
• Agency Services: Custom web design, development, mobile app development, digital marketing, SEO, and branding services
• Tools & Features: Analytics, SEO tools, form builders, email marketing, and other features available through our platform

We reserve the right to modify, suspend, or discontinue any part of our Services at any time, with or without notice.

3 Accounts & Registration

Some features of our Services require you to create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Keep your password secure and confidential
• Accept responsibility for all activity that occurs under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 13 years old (or the minimum age in your jurisdiction) to create an account. We reserve the right to suspend or terminate accounts that violate these Terms.

4 Acceptable Use

You agree not to use our Services to:

• Violate any applicable laws, regulations, or third-party rights
• Upload or distribute malware, viruses, or harmful code
• Send spam, unsolicited messages, or engage in phishing
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the integrity of our Services
• Reverse engineer, decompile, or disassemble any part of our software
• Use automated tools (bots, scrapers, crawlers) to access our Services without permission
• Create or host content that is illegal, defamatory, obscene, or infringes on others' rights
• Impersonate another person or entity
• Resell or redistribute our Services without authorization

We reserve the right to investigate and take appropriate action against anyone who violates these restrictions, including removing content, suspending accounts, or reporting to law enforcement.

5 Intellectual Property

All content, features, and functionality of our Services — including but not limited to text, graphics, logos, icons, images, audio, video, software, code, templates, and designs — are owned by DMV Web Guys or our licensors and are protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for their intended purpose, subject to these Terms. This license does not include the right to modify, copy, distribute, sell, or create derivative works from our Services without our express written permission.

For agency clients: Upon full payment for custom work, ownership of deliverables (custom designs, code, and content created specifically for your project) transfers to you, unless otherwise specified in a separate agreement. Templates, frameworks, and proprietary tools remain our property.

6 User Content

You retain ownership of content you create or upload through our Services ("User Content"). By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, display, reproduce, and process your content solely for the purpose of providing and improving our Services.

You represent and warrant that:

• You own or have the right to use and share your User Content
• Your User Content does not violate any third party's intellectual property or privacy rights
• Your User Content complies with all applicable laws and these Terms

We do not monitor all User Content but reserve the right to remove content that violates these Terms or is otherwise objectionable.

7 Payments, Subscriptions & In-App Purchases

7.1 Website & Platform Subscriptions

Certain features require a paid subscription. When you subscribe, you agree to pay the applicable fees. Subscriptions automatically renew at the end of each billing period unless canceled before the renewal date. You can cancel your subscription at any time through your account settings or by contacting support.

7.2 Mobile App Purchases

Purchases made through our mobile applications (including subscriptions and one-time purchases) are processed by Apple (via App Store) or Google (via Google Play). These transactions are governed by the respective platform's terms of service. Refund requests for in-app purchases should be directed to the platform where the purchase was made.

7.3 Agency Services

Custom agency services are governed by individual project agreements. Payment terms, deliverables, timelines, and refund policies for agency work will be specified in the relevant project proposal or contract.

7.4 Refunds

Refund eligibility depends on the service:

• Platform subscriptions: We offer a 30-day money-back guarantee for new subscriptions
• In-app purchases: Handled by Apple or Google per their respective refund policies
• Agency services: Governed by individual project agreements

8 Termination

You may stop using our Services at any time. You may also request account deletion by contacting us at support@dmvwebguys.com.

We may suspend or terminate your access to our Services at any time, with or without cause, including if we reasonably believe you have violated these Terms. Upon termination:

• Your right to access and use our Services immediately ceases
• We may delete your account and User Content after a reasonable period
• Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and dispute resolution) will continue to apply

9 Disclaimers

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that our Services will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We are not responsible for any damage resulting from your use of our Services.

10 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DMV WEB GUYS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES, REGARDLESS OF THE THEORY OF LIABILITY.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

11 Indemnification

You agree to indemnify, defend, and hold harmless DMV Web Guys and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from your use of our Services, your User Content, or your violation of these Terms.

12 Dispute Resolution

These Terms are governed by the laws of the State of Maryland, United States, without regard to conflict of law provisions. Any disputes arising from or relating to these Terms shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association, held in the State of Maryland.

You agree to resolve disputes individually and waive any right to participate in class action lawsuits or class-wide arbitration.

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights.

13 General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and DMV Web Guys regarding our Services.
• Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
• Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
• Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights without restriction.
• Changes to Terms: We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, via email or in-app notification. Your continued use of our Services after changes take effect constitutes acceptance.
• Force Majeure: We are not liable for any failure to perform due to causes beyond our reasonable control, including natural disasters, pandemics, government actions, or internet service interruptions.
